4.4.3　語句以及語篇成分的安排問題

法律漢語與法律英語的差別會給法律法規(guī)英譯時語句與語篇成分的安排造成困難。中國法律法規(guī)翻譯中有時出現(xiàn)語句紊亂問題。

例5.未經(jīng)審批管理機關批準，擅自轉讓探礦權、采礦權的，由登記管理機關責令改正，沒收違法所得，處10萬元以下的罰款；情節(jié)嚴重的，由原發(fā)證機關吊銷勘查許可證、采礦許可證。

Whoever without authorization，transfers exploration rights or mining rights without approval of the examining and approving agency，shall be ordered to make amends by the Registration agency，have confiscated its illegal gains and be imposed a fine of not more than 100,000 yuan；the circumstances are serious，the original licensing agency shall revoke the exploration license or mining license.

此處沒有承接上文的主題，在分號處進行了轉換，既不符合原文也不符合法律英語的一般習慣。

由于拘于原文句式，譯者往往沒有較大的自由選擇法律英語的句式，例如，主動與被動的選擇、羅列與陳述的選擇、主句與從句的選擇等。因此，法律英語的很多典型特點（見Mellinkoff，1963；O’Barr，1982；Gonzalez，1991；Crystal and Davy，1979；Bhatia，1984；Gibbons，2003等）不能反映在譯文中，在有限范圍內，譯者未能最大限度地利用條件在雙方語言都許可的情況下，盡量采用法律英語的習慣表達。

代詞的使用屬于語篇層次的問題，法律法規(guī)英譯中也出現(xiàn)有代詞使用不妥的情況。

例6.國（境）外單位和個人違反本辦法的規(guī)定，未經(jīng)批準，私自采集、收集、買賣我國人類遺傳資源材料的，沒收其所持有的人類遺傳資源材料并處以罰款。情節(jié)嚴重的，依照我國有關法律追究其法律責任。

If any foreign unit or individual，in violation of the provisions of these Measures，secretly samples，collects or deals in human genetic resource materials of our country without approval，the human genetic resource materials held in its possession shall be confiscated and a fine shall be imposed；if the circumstances are serious，it shall be investigated for legal liability in accordance with relevant laws of our country.

此例中的it并沒有確切的所指，會造成理解困難。
